1. Introduction

Welcome to RemoteTuning.com, a comprehensive platform designed to facilitate communication and data organization between automobile tuners and their customers. This Terms of Service agreement ("ToS") is a binding contract between you, the user ("User"), and us, RemoteTuning, a company legally domiciled in Florida ("we", "us", "our"). This ToS governs your utilization of and access to our array of services, encompassing our websites, application programming interfaces (APIs), applications, email notifications, and any other services that link to this ToS (collectively known as the "Services"). The Services also include any information, text, links, graphics, photos, videos, or other materials or arrangements of materials uploaded, downloaded, or appearing therein (hereafter referred to as "Content").
By using our Services, you acknowledge and agree to be bound by these ToS. If you are utilizing the Services on behalf of an organization or entity, you consent to these ToS on their behalf and affirm that you have the requisite authority to bind said entity to these ToS. In such instances, "you" and "your" will denote the entity you represent.

2. Services

RemoteTuning.com serves as a secure communication and data organization platform for automobile tuners and their clients. Note that we do not provide car tuning services. Our platform facilitates a private and encrypted communication medium for tuners to send tuning files, receive feedback, and interact with clients.

3. User Accounts and Roles

Our platform caters to two primary user roles: Tuners and Customers, each having distinct roles, permissions, and capabilities within our ecosystem.

3.1 Tuner Accounts

Tuners looking to utilize our Services must create an account and accede to this ToS. A monthly subscription fee, which may vary based on usage, is applicable to Tuner accounts. This fee will be billed at the end of each month. Please note that the fee structure is subject to modifications and any changes therein will be conveyed to the users ahead of time.

3.2 Customer Accounts

A Customer account can be initiated by a Tuner when establishing a tuning relationship. Upon initiation, the Customer will receive an email notification prompting them to finalize the registration process. Customer accounts are freely available and enable Customers to send and receive feedback on tunes.

4. Rights and Responsibilities

4.1 User Rights and Responsibilities

As a User, you reserve the right to:

Access and employ our Services in accordance with these ToS.
Opt-out of receiving communications from us, achievable by following the instructions outlined in the communications.

Your responsibilities as a User include:

Adherence to all relevant laws, rules, and regulations in relation to your use of our Services and any Content you submit.
Ensuring the accuracy and quality of data submitted to our Services.
Safeguarding the confidentiality of your account and password information.

4.2 RemoteTuning.com Rights and Responsibilities

As the provider of the Services, RemoteTuning.com reserves the right to:

Update, alter, or terminate any aspect of our Services as required.
Suspend or terminate User access to the Services for non-compliance with these ToS.
Refuse provision of Services to anyone for any reason at any time.

RemoteTuning.com is responsible for:

Providing Services as delineated in these ToS.
Protecting User information in line with our Privacy Policy.
Informing users of any changes to our Services, inclusive of alterations in these ToS or our service pricing structure.

5. Content and Conduct

5.1 Prohibited User Conduct

You are expressly prohibited from:

Utilizing the Services for any unlawful purposes or in violation of any local, state, national, or international law.
Violating or inciting others to violate the rights of third parties, particularly intellectual property rights.
Posting, uploading, or distributing any Content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, or otherwise inappropriate.
Interfering in any manner with the operation of the Services or any server, network, or system associated with the Services. This includes, without limitation: hacking, mail-bombing, flooding, overloading, or instigating "denial of service" attacks; probing, scanning, or testing the vulnerability of the Services or any server, network, or system associated with the Services; violating or circumventing firewall, encryption, security, or authentication routines.

6. Payment Terms

Users who purchase our Services agree to pay all relevant fees, including any subscription fees for our Tuner accounts. All such fees are non-refundable except as required by law. We retain the right to modify or introduce new fees for any existing Service by providing advance notice to you. We may occasionally alter our fees for promotional events or new services, and such changes become effective when we post the promotional event or new service on the Services.

7. Limitation of Liability

In no event shall RemoteTuning.com, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses. This covers circumstances arising from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content. These limitations apply irrespective of whether they are based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damage, even if a remedy set forth herein is found to have failed of its essential purpose.

8. Changes to Terms

We reserve the right to revise these Terms at any time. We will inform you of any changes to these Terms by posting the new Terms here and updating the "Last Updated" date at the top of these Terms. Should you disagree with the revised Terms, your sole recourse is to discontinue using the Services.

9. Governing Law & Jurisdiction

This ToS, and any disputes arising from or relating to the interpretation thereof, will be governed by and construed under the laws of the State of Florida. Any legal action or proceeding arising under this Agreement will be brought exclusively in the federal or state courts located in Florida, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

RemoteTuning.com does not share, sell, or distribute any personal information of our users, including tuners and customers. We do not request a license to utilize or monetize any user information. We maintain a strict policy of confidentiality and never use or disclose any data or content transmitted through our platform.

We reserve the right to modify this Privacy Policy at any time. Changes and updates will be effective immediately upon posting on our website. It is your responsibility to review this Privacy Policy periodically for any revisions.
